Mexican Real Estate Trusts
In general, Mexican real estate bought by foreign investors held in a trust. The duration of the trust is 50 years, and can be extended for an additional 50 years. Banks usually hold such trusts.
If the Mexican real estate being sold is already held in trust, the beneficiary (owner) of the trust can transfer his or her interest to the new buyer. Transferring a trust does not reset the 50-year lifetime of the trust, so the new beneficiary would have the remainder of the trust period – which can be renewed for an additional 50 years when the initial trust expires. The primary advantages of transferring a trust are the savings in time and fees.
Trusts can also be extinguished and reformed. In these circumstances, the new beneficiary (owner) would have the benefit of the full 50-year trust. As with a transferred trust, the beneficiary has the option of renewing the trust for an additional 50 years.
